Terms and Conditions
The General Terms and Conditions of JUST International AG and JUST Schweiz AG (HEREINAFTER referred to as JUST) apply exclusively to the sale of tickets for all events and services by JUST for purchasers and customers (hereinafter referred to as: "purchasers").
1 Validity
1.1
The General Terms and Conditions of JUST International AG and JUST Schweiz AG (hereinafter referred to as JUST) apply exclusively to all events and services provided by JUST. In particular, the GTC apply for JUST’s own ticket shop. The scope of the GTC includes events and services which are organised or provided by JUST itself, as well as events and services which are carried out or provided by third parties and sold or offered for reservation for them by JUST or third parties on the internet. In particular, the GTC apply to all events and services (discovery and factory tours, also combined with events and catering visits as well as various products sold at the site) which are sold, organised or provided by JUST in connection with the “JUST World” and which are bought, booked or reserved by purchasers from JUST on the internet.
1.2
The purchasers expressly agree to the applicability of JUST’s GTC by clicking on a corresponding button during the online booking or reservation process on the internet (hereinafter referred to generally as: “online ordering process”. At the same time they confirm that they have read the General Terms and Conditions. The GTC of JUST are made available and accessible to the purchasers during the ordering process by means of a corresponding link to the website www.just.swiss.
1.3
The GTC of JUST take precedence over any of the purchaser’s other terms and conditions.
1.4
Deviations from the GTC of JUST apply only if they are agreed in writing with the purchasers or recognised by JUST in writing.
2 Conclusion of contract and tickets
2.1
A contract is concluded with the purchasers during the online ordering process on the internet after acceptance of JUST’s GTC (as stated in Section 1.2 above) and by clicking a corresponding button for the purchase or reservation of the events and services offered by JUST with the reservation confirmation of JUST.
2.2
In the case of sales or online distribution of JUST products as well as events and services which are organised or provided by JUST itself on the internet, a direct contract is concluded between JUST and the purchasers. In the case of the sale of events and services carried out or provided by third parties, in particular travel, tour or car companies, a direct contract is concluded between JUST and the third party. The third party shall indemnify and hold JUST harmless from any claims of the event participants, unless there is gross negligence on the part of JUST.
2.3
If online orders for events and services are placed on the internet, the purchaser acquires a transferable ticket which entitles them to participate in the corresponding events and/or to obtain the corresponding services. This ticket is valid for 1 (one) year and is either sent in printed paper form to the purchaser with written confirmation of order by post or sent as a print@home ticket by email to the address specified by the purchaser during the online ordering process. Tickets for events and services cannot be exchanged or returned.
If tickets cannot be purchased for events and services on the internet, but it is only possible to reserve places, a reservation confirmation will be sent to the purchaser by email to the address provided during the online ordering process. A reservation can be cancelled at the latest up to five working days before the event, after which it is binding and the purchase price for the event must be paid. The organiser must be informed either by email or phone if a reservation is cancelled. If a reservation for a group of more than 50 people is cancelled, we reserve the right to charge the organiser for the expenses already incurred, but at least CHF 350.00, regardless of when the cancellation was made.
2.4
If the written form is required for legally relevant declarations, order and reservation confirmations or other agreements, email is also regarded as the written form.
3 Prices
Unless otherwise agreed in writing, the prices of JUST for the tickets for events and services are net and duty unpaid (without deduction of any discount, plus expenses and costs for packaging, transport and insurance as well as any taxes, in particular VAT and fees of any kind).
4 Terms of payment
For reservations of events or services, the price must be paid directly to JUST at the company’s premises or will be invoiced to the organiser.
5 Scope of services
With the tickets purchased or with the reservation confirmation, the purchasers of JUST’s own events and services will acquire the right to receive the services and to enter and attend the booked event (in accordance with the order confirmation or reservation confirmation) provided that the price for the corresponding event or service has been paid in full. The right of entry and attendance is subject to the condition that the purchasers as event attendees meet the entry and/or age requirements of the event in question. If such conditions apply, these are noted in the description of the event at www.just.swiss.
6 Obligations of the purchaser and ticket recipient
The purchasers of events and services of JUST or third-party organisers, as event visitors and especially as course attendees, undertake to observe all safety and implementation regulations as well as all relevant instructions from JUST or third-party organisers which are communicated to them by JUST or third-party organisers or their assistants either verbally or in writing either during or after the event or course.
7 Denial and exclusion of performance
JUST or a third-party organiser is entitled to a) deny entry of the purchaser to the event without reimbursement or b) exclude a purchaser from the event during the event if the latter, as an event attendee, does not meet the entry requirements, in particular the age limits applicable for the event, or if, despite being requested by JUST or the third-party organiser or their assistants, the purchaser does not comply with the security and/or implementation regulations of JUST or the third-party organiser.
8 No guarantee for the correctness of the event data
Due to the influences of the ticket sales system resulting from transmission errors, technical faults or illegal interference by third parties which cannot be fully excluded, JUST cannot provide any guarantee for the correctness and completeness of the event data specified or published on the internet at www.just.swiss for its own events or third-party events.
9 Postponement and cancellation of events
If a purchaser cancels their attendance at an event booked by this purchaser (Section 2.3), the purchaser shall not have the right to exchange or return the ticket for this event, regardless of the reason for this postponement. Within the scope of the validity period of their ticket, the relevant purchaser retains the option and the right to attend the same event on another regular date as offered by JUST.
If an event booked or reserved by a purchaser is cancelled or postponed by JUST or by a third-party organiser, the purchaser does not have any right to exchange or return the ticket, regardless of the reason for this postponement, if, within the remaining validity period of the ticket, it is possible to attend the postponed event on another regular date advertised by JUST on the internet or on a substitute date offered by JUST or a third-party organiser. In the case of third-party events, the purchaser has no right to demand a refund or exchange of the ticket from JUST, and any refund or exchange of the tickets must be demanded by the purchaser directly from the third-party organiser.
If a separate event advertised by JUST on the internet is finally cancelled by JUST or a third-party event by its organiser so that it can no longer be attended during the validity period of the tickets, the purchaser of the ticket for the event shall, irrespective of the reason for the postponement, have the right to exchange or return the ticket they purchased for this event. If an affected purchaser chooses to return the tickets for JUST’s own events, they will be reimbursed with the ticket price paid to JUST during the online transaction as well as the shipping costs. In the case of third-party events, the purchaser has no right to claim reimbursement from JUST, and any refunds must be claimed by the purchaser directly from the third-party organiser.
10 Disclaimer
JUST shall be liable to the purchaser of tickets for its own events and services for any damage caused by JUST or its employees or auxiliary personnel in the performance of such events and services, subject to Art. 100 para. 1 of the Swiss Code of Obligations (Schweizerisches Obligationenrecht) only insofar as cover is provided within the scope of JUST’s business liability insurance.
Insofar as JUST only acts against the third-party organiser with regard to third-party events, within the framework of applicable legislation, any liability of JUST for any damage suffered by the event participants as attendees of third-party events before, during or after these events is excluded, irrespective of whether this damage has been caused by the third-party organiser, by auxiliary personnel of the third-party organiser or by third parties.
The liability and warranty claims of the purchaser towards JUST for events and services are conclusively regulated in these General Terms and Conditions. The purchaser shall not be entitled to any additional or other claims, under whatever title, and these shall be deemed to be excluded. In particular, JUST shall not be liable for any consequential damages or lost profits. Mandatory statutory warranty provisions are reserved.
11 FINAL PROVISIONS
Transfer of rights
The parties are not permitted to transfer rights and obligations from a contract to third parties without the prior written consent of the other party.
Severability
In the event of invalidity of individual provisions of the General Terms and Conditions of JUST towards purchasers, the remaining provisions shall remain in full force and effect. Invalid provisions shall be replaced by those which come closest to the legal meaning and the intended purpose of the ineffective or invalid provision. The same regulation as for partial invalidity also applies in the case of a gap in the contractual regulations.
Governing law
All legal relations between JUST and third-party organisers and/or the purchasers are exclusively assessed in accordance with Swiss law, with the complete exclusion of conflict-of-law standards and with the exclusion of the UN Convention of April 11, 1980 on contracts relating to the International Sale of goods (Vienna Sale of Goods Law).
Place of jurisdiction
Disputes between JUST and third-party organisers and/or purchasers concerning booked events and services shall be decided by the courts at the legal headquarters of JUST with the exclusion of all other courts.
